Filing your Nebraska state income tax return

For most taxpayers the filing status is usually the same, however there areexceptions to the rule. Married military members often file separate on theNebraska return and joint on the federal.

Also if married couple areare not living in the same state, they may file married filing joint for the federal return and married filing separate forthe state tax return.

Nebraska allows taxpayers to choose whether to itemize deductions or take the standard deduction regardless of what you did on your federal return.

Besides the personal exemption credit, which is worth $97 per each federal exemption, Nebraska offers the following credits:

  • Credit for taxes paid to another state
  • Credit for the elderly
  • CDAA Credit (Community Development Assistance Act)
  • 3800N Credit
  • 829N Credit
  • credit for child and dependent care expenses
  • gasoline tax credit
  • Beginning Farmer Credit

The common deductions allowed in Nebraska are:

  • State income tax refund deduction.
  • Taxable Tier I or II benefits (railroad retirement board)
  • Special Capital Gains election
  • Nebraska self-employed health insurance deduction
  • Nebraska College Savings Plan contribution deduction
  • Native American Indian Reservation Income
  • Nebraska Net Operating Loss carry forward

Nebraska residents pay tax on retirement income that is taxedfederally. This also applies to retirement income from another state.

Capital gains are taxed at the same rate as the rest of your Nebraska income.

As a nonresident employed in Nebraska, you must file Form 1040N and Schedule III.
